1. Operator and contact
Cresswell Academic is operated by Dominic Toussaint from Weteringschans 110 H, 1017 XS Amsterdam, the Netherlands. KVK number: 42183979. The contact address for all service matters is contact@cresswellacademic.com.
2. Forming an agreement
Students of any age may enquire about SAT tutoring. Submitting an enquiry does not create a paid contract. An agreement begins when Cresswell confirms in writing the student, tutor, SAT section, lesson format, schedule and applicable terms, and the student or the person authorised to act for them accepts those details. A parent or guardian must contract for a student who cannot lawfully contract independently.
3. Services and educational responsibility
Cresswell’s only current tutoring offer is online preparation for the SAT and Digital SAT, covering Math and Reading and Writing. Tutors may be independently contracted professionals working to Cresswell standards. Cresswell does not complete assessed work, guarantee scores or admission, or replace a school’s academic or pastoral responsibilities. The student remains responsible for attendance, learning and submitted work.
4. Tutors and verification
Before approval, a prospective tutor must complete a live video interview with Dominic Toussaint and provide evidence of relevant diplomas or qualifications. Cresswell may request further evidence where reasonably necessary. This screening is not represented as a criminal-record check. Availability and suitability are assessed for each family individually.
5. Lessons and Google Meet
Lessons ordinarily take place through Google Meet using the joining details supplied by Cresswell. Families must provide a suitable device, internet connection and learning environment. Students should not move communications to unapproved private channels. Lessons are not recorded unless there is a specific lawful reason and appropriate prior consent.
6. Pricing, invoices and payment
Current prices and any package terms are provided before booking. Dominic Toussaint issues invoices manually, stating the payment method and due date. The website does not collect or store payment-card information. A student or family should query an invoice promptly by email.
7. Cancellations
A lesson may be cancelled or rearranged without charge by giving at least 24 hours’ notice. With less than 24 hours’ notice, or for non-attendance, the full lesson price may be charged because the tutor’s time was reserved. If Cresswell or the tutor cancels, the family may choose a replacement lesson, credit or refund for the affected prepaid lesson. The separate Cancellation and Refund Policy forms part of these terms.
8. Consumer withdrawal rights
Where mandatory consumer law provides a 14-day withdrawal period for a distance contract, that right remains available. If a family expressly asks for lessons to begin during that period, Cresswell may charge a proportionate amount for services already supplied. The withdrawal right may end once a service has been fully performed where the consumer gave the required prior consent and acknowledgement.
9. AI and academic integrity
AI may be used as a supervised learning tool, subject to the student’s institutional rules. Students must not submit AI-generated work as their own, fabricate sources or use AI in a prohibited assessment. AI output must be checked rather than assumed correct. Unnecessary identifying, confidential or sensitive information must not be entered into AI tools.
10. Safeguarding and conduct
Families, students and tutors must follow the Safeguarding Policy and use respectful, professional conduct. Cresswell may suspend or end a relationship immediately where there is a safety, harassment, dishonesty, boundary or academic-integrity concern.
11. Intellectual property
Cresswell and tutor-created materials remain the property of their respective owners. The student receives a personal, non-transferable right to use supplied materials for private learning. Materials may not be sold, published or commercially redistributed without permission.
12. Availability and liability
Cresswell will use reasonable care in selecting tutors and arranging services but cannot promise uninterrupted technology or a particular academic result. To the extent permitted by law, Cresswell is not responsible for indirect or unforeseeable loss, and aggregate liability arising from the service will not exceed the fees paid for the affected SAT tutoring during the preceding three months. Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer rights, fraud or liability for death or personal injury caused by negligence.
13. Complaints, law and disputes
Complaints should first be sent to contact@cresswellacademic.com so that Cresswell can try to resolve them promptly. These terms are governed by Dutch law. Consumers retain any mandatory protections and competent forum rights available under applicable consumer law. If a dispute cannot be resolved informally, it may be brought before the competent Dutch court unless mandatory law provides otherwise.
14. Changes
Cresswell may update these terms prospectively. The version accepted when a booking is confirmed applies to that booking unless a change is required by law or expressly agreed.
